One Roof Terms of Use

1. Acceptance of Terms

Welcome to the Terms of Use for the www.OneRoofrealestate.com website and any associated applications or services (collectively, the “Platform”). This Agreement (“Agreement”) is between One Roof, LLC (“One Roof,” “we,” “us,” or “our”) and you (“you,” “your,” or “user”).

By clicking “I agree” or accessing/using the Platform, you accept this Agreement and our Privacy Policy, which is incorporated by reference. If you do not agree, you must discontinue use of the Platform immediately.

PLEASE NOTE: THIS AGREEMENT CONTAINS AN ARBITRATION CLAUSE AND CLASS ACTION WAIVER.

2. Accounts & Responsibilities

Some Platform features may require account registration. You agree to provide accurate and current information and to maintain confidentiality of your login credentials. You are solely responsible for activity under your account.

3. Privacy & Consumer Data Rights

Your use of the Platform is governed by our Privacy Policy, which explains how we collect, use, and safeguard your data.

• Compliance with Privacy Laws (2025): We comply with all applicable state privacy laws, including those in California, Colorado, Virginia, Utah, Connecticut, Delaware, Iowa, Maryland, Minnesota, Nebraska, New Hampshire, New Jersey, and Tennessee.

   

• Global Privacy Control (GPC): For California, Connecticut, and New Jersey residents, we honor GPC browser signals as valid opt-outs of targeted advertising and data sales.

   

• No Sale of Data: We do not sell, rent, or share personal data with third parties for their independent marketing purposes.

   

4. TCPA & FCC Communications Compliance

By providing your phone number, you consent to receive non-marketing communications (service notices, account updates).

• Marketing calls or texts require your prior express written consent, as required by the Telephone Consumer Protection Act (TCPA) and FCC rules (updated 2025).

   

• You can opt out of texts by replying “STOP” or emailing admin@OneRoofrealestate.com.

   

• Consent is not a condition of purchase.

   

5. Subscription & Cancellation Rights

If we provide any subscription-based services, cancellation will be as simple as sign-up, consistent with the FTC’s “Click-to-Cancel” rule effective July 14, 2025.

6. Use of Platform & Disclaimers

The Platform is provided “as-is” without warranties. Price Estimates are for informational purposes only and are not binding offers. You agree not to rely solely on Platform content for financial, legal, or real estate decisions.

7. User Content

You are responsible for any content you submit. You grant One Roof a license to display and distribute such content as necessary for the operation of the Platform. Content that violates law, third-party rights, or our guidelines may be removed.

8. CFPB & Financial Transparency

If our services involve financial data, we will comply with evolving rules from the Consumer Financial Protection Bureau (CFPB) related to open banking and consumer control over financial data.

9. Limitation of Liability

To the fullest extent allowed by law, One Roof is not liable for damages arising from your use of the Platform, except as required by applicable law (with specific protections for New Jersey residents).

10. Arbitration & Class Action Waiver

Except where prohibited, disputes must be resolved by binding arbitration under the AAA Rules in Maricopa County, Arizona. Class or representative actions are not permitted.

11. Additional Legal Terms

• Intellectual Property: All Platform content and trademarks are owned or licensed by One Roof.

   

• Age Compliance: You must be at least 18 years old to use the Platform.

   

• Force Majeure: We are not responsible for service failures due to events beyond our control.

   

• Severability & Non-Waiver: If any provision is invalid, the remainder remains enforceable.

   

• Amendments: We may update these Terms from time to time. Continued use constitutes acceptance.

   

• Entire Agreement: These Terms and the Privacy Policy constitute the full agreement, except where superseded by a Purchase Agreement.

   

12. SMS/Text Messaging Terms

By providing your mobile phone number to One Roof, you agree to the following SMS/Text Messaging Terms, in addition to this Agreement and our Privacy Policy:

1. Consent to Receive Messages

   • By opting in, you consent to receive recurring informational and/or promotional text messages from One Roof, LLC, which may be sent using an automatic telephone dialing system or other technology.

   • Your consent is not a condition of purchase.

2. Types of Messages

   • Non-marketing messages may include account updates, service notifications, and confirmations.

   • Marketing/promotional messages will only be sent with your prior express written consent in compliance with the Telephone Consumer Protection Act (TCPA) and FCC rules.

3. Opt-Out & Assistance

   • You may opt out at any time by replying “STOP” to any message you receive.

   • For help, contact us at admin@OneRoofrealestate.com.

   • After opting out, you may receive one final message confirming your opt-out request.

4. Message Frequency & Costs

   • Message frequency may vary.

   • Message and data rates may apply, depending on your wireless carrier plan.

5. User Responsibilities

   • You are responsible for providing a valid mobile phone number and updating it as needed.

   • If you change or deactivate your number, you must notify us promptly to prevent misdirected messages.

6. Carriers Disclaimer

   • Wireless carriers are not liable for delayed or undelivered messages.

7. Compliance

   • These SMS Terms are intended to comply with applicable federal and state laws, including the TCPA, FCC regulations, and state consumer privacy laws effective in 2025.
